TCRC Central LE Website Terms of Use:

User Agreement:

1. Every person who accesses the TCRC Central LE website consents, as a User, to the terms of use stated in the present document and to the fact that the Teamsters Canada Rail Conference Central Region (TCRC Central LE) and the TCRC Central LE website reserves the right to amend these terms from time to time.

Privacy Protection:

2. TCRC Central LE abides by Canadian and international standards with regard to user privacy protection. TCRC Central LE does not collect personal information about Users without their consent, and has set up means to keep personal information confidential. The TCRC Central LE website’s management of personal information is described more fully on the Privacy Policy page.

Reproduction and Copyright:

3. TCRC Research reserves the intellectual property rights pertaining to the TCRC Central LE website’s graphic, navigation and search tool design.
4. Subject to the following paragraph and the below conditions pertaining to prohibited use, materials published on the public access pages of the TCRC Central LE website, such as legislation, regulations and decisions, including editorial enhancements inserted into the documents by TCRC Central LE, such as hyperlinks and information in headers and footers, can be copied, printed and distributed by Users free of charge and without any other authorization from TCRC Central LE, provided that TCRC Central LE is identified as the source of the document.

5. Use of materials published by TCRC Central LE can be subject to additional conditions set by courts and government bodies claiming intellectual property rights relating to the documents. TCRC Central LE may make an effort to indicate the existence of additional conditions on the pages of the relevant materials, but Users remain responsible for checking whether the intended use of the documents is authorized.

Prohibited Uses:

6. Notwithstanding the reproduction rights granted in the preceding section, the following uses of TCRC Central LE’s website are prohibited unless the TCRC Central LE administrator has provided prior written consent:

  1. Incorporating materials published on the Login access pages of the TCRC Central LE website, such as legislation, regulations and decisions, TCRC Central Region LE internal and published documents, into another website, blog, social media format, or public posting.
  2. Incorporating published documents into another website but masking their origin or source through framing, re-use of search processes, or any other means of creating confusion and misrepresenting the fact that the documents come from the TCRC Central LE website;
  3. External indexing of published documents by Web robots;
  4. Use of the TCRC Central LE website’s resources and services via automated mechanisms, in particular for bulk downloading of documents;
  5. Re-distribution of authorized registration information, including the user name and password to another individual(s).

TCRC Central LE reserves the right to block, at its discretion and without prior notice, any user from accessing its website if the user misuses the website or uses it for unauthorized purposes.

8. TCRC Central LE puts considerable effort into maintaining its website and controlling the quality of the posts and documents it publishes so as to provide a reliable source of information. However, the TCRC Central Region LE and the TCRC Central LE website provides no warranty and makes no claims as to the reliability, accuracy or integrity of the website’s content or functioning.

1. TCRC Central LE collects and stores only the personal information supplied at registration. When personal information on users is received, TCRC Central LE treats it with utmost confidentiality. TCRC Central LE complies with applicable Canadian legislation and Teamsters Canada Rail Conference on privacy protection.

2. TCRC Central LE adheres to the principle of openness and transparency of legislative and judicial processes, and recognizes their fundamental importance in democratic societies. In order to minimize the negative impact of such transparency on the privacy of those involved in cases leading to judicial decisions, TCRC Central LE does not permit its information to be indexed by external search engines.

Information on Website Users

3. TCRC Central LE keeps only the personal information on a site user provided at registration, and the user agrees that such information will be made available to other authorized users. When a user contacts TCRC Central LE, personal information may be conveyed at the user’s discretion. TCRC Central LE considers such information to be confidential. Personal information on users that comes into TCRC Central LE’s possession is destroyed or erased as soon as TCRC Central LE no longer requires it for the purposes for which it was provided.

4. TCRC Central LE gathers information on the use of its services for the sole purpose of keeping statistics on visits and ensuring smooth operation of its website’s services. The information gathered is never disclosed to third parties, unless such disclosure is required by law or needed to prevent misuse or unauthorized use of services offered by TCRC Central LE.

5. When a user accesses a website, various pieces of information circulate between the user’s computer and the website’s server. TCRC Central LE stores the transactional information related to user computers, including, but not limited to:

8. When users complete the contact form, it is possible for them to provide additional information. The information is used and stored only as required to process the request and to establish general statistics.

Mailing List:

9. Authorized users will be placed on the TCRC Central LE mailing lists and must provide valid email addresses. The information is gathered uniquely for the purposes of managing and operating the list, and is destroyed when the user’s authorization is terminated. Users can correct information and terminate subscriptions themselves by contacting the TCRC Central LE administrator.

10. All information gathered by TCRC Central LE is kept in a secure computer environment to which access is restricted. TCRC Central LE employees who gather, store and use personal information are required to ensure that their activities comply with the present policy. TCRC Central LE makes a commitment to maintain a high degree of security.

Information in Documents Published by TCRC Central LE:

11. TCRC Central LE publishes documents in the form in which they are received from the institutions that issue them, such as CROA&DR and other official publishers. Material provided by TCRC Central Region LE and others are the property of those that originally produced them. Material uploaded to TCRC Central LE is done so with the understanding that they will be used in accordance with the terms of use policy.

13. With respect to court decisions, the transparency characteristic of the Canadian judicial system protects the impartiality of the judiciary, ensures the fairness of the judicial process and enables individuals to base their conduct on precedents established by judges. TCRC Central LE does not edit the content of court decisions except to comply with publication bans imposed by statutes or courts and in accordance with the policies of the institution that provided the text of the decision.

Indexing of Decisions by External Search Engines:

14. Through application of recognized web robot exclusion protocols and by restricting indexing activities in its terms of use, TCRC Central LE prohibits external search engines from indexing the text and case name of decisions published on its website. When indexing prohibitions in robot exclusion protocols are complied with, searching for the name of an individual using an Internet search engine does not return decisions published on TCRC Central LE. However, when a third party links to a TCRC Central LE decision on a web page that is not under TCRC Central LE’s control, names that are included in this page or in the link’s text might still be indexed by external search engines. Neither TCRC Central LE nor its partners represent or guarantee that the technological and legal measures taken to prevent external indexing will be respected or be free of mistakes or malfunctions.

Requests Concerning the Content of Published Documents:

15. All requests concerning the content of a document published on the TCRC Central LE website should be submitted to TCRC Central LE’s administrator using the contact form. If the request is to withdraw or amend a decision, it will be studied in light of applicable rules pertaining to publication restrictions. Requests for withdrawal or amendment that are not justified by relevant legislative provisions or a court order restricting publication will be refused. Persons wishing to submit a request for withdrawal but who do not know the law applicable to their situation are asked to contact their lawyer or the registry of the court that rendered the decision.
